Ifeanyi Ubah: ARREST MUHAMMAD SANUSI II, OR RELEASE IFEANYI UBAH - CIVIL RIGHTS ADVOCATES OF NIGERIA Calls For Equity, Justice And Fairness
June 2, 2017
We have watched and observed patiently as the Executive Arm of Nigerian Government ably represented by their various security agencies from the Police, to the EFCC and the DSS trample on the rights of the citizenry with impunity and alacrity without observing the rule of law which is the foremost tenet of a democratically elected government.
So many examples suffice on how the Nigerian security agencies carry out their responsibility of maintaining law and order unmeritoriously against the backdrop of ethnic and religious tension at this delicate moment of Nigeria's existence.
We want the DSS to clarify why Ifeanyi Ubah the MD of Capital Oil will be arrested and detained unlawfully against the subsisting order of release by two courts of competent jurisdiction?
In Nigeria where we practice the common English law, the relevant security agencies are very free to invite, arrest and detain any person they suspect to have committed a crime according to the criminal code. They also retain the powers from the criminal code to release the suspect on bail within 24 hours or also chose to detain the said suspect while conducting further investigations into the alleged crime.
However, no Security outfit has the right to detain any suspect for more than the period stipulated by law without charging same to a relevant court for subsequent prosecution as every suspect is assumed innocent until proven guilty before the court of law.
Does the DSS possess the legal right to proclaim a suspect who is yet to be tried by the law court as guilty of a life sentence?
Is it in their jurisdiction to arrest and at the same time adjudicate?
These questions are begging for answers. But before then, in the interest of a level playing ground, in the interest of national justice, equity and fairness, the DSS should also be prompt to arrest MUHAMMAD SANUSI II (THE EMIR OF KANO) for the same alleged misappropriation and /or diversion of billions of naira, the same crime for which IFEANYI UBAH (THE PREMIER OF CAPITAL OIL AND GAS) has been arrested, detained and humiliated.
We the CIVIL RIGHTS ADVOCATES OF NIGERIA will always be alert to fight legally for the rights of the oppressed in a country where the sanctity of human life and the rights of the citizenry from whom power is derives its authority are thrown to the mud.
DSS IT IS EITHER YOU ALSO ARREST AND PROBE EMIR SANUSI NOW OR BE CIVIL ENOUGH TO RELEASE IFEANYI UBAH AS TWO COURTS OF COMPETENT JURISDICTION HAS ORDERED FOR HIS RELEASE.
